As with our Title 43a guardianships the use of the APS Guardianship Voucher should be of last resort when no other lesser restrictive services can meet the client’s needs. The case needs to reflect this in your documentation. Additionally, whether it is a Service Case or Investigation there must be a face-to-face visit with the client, the client must lack capacity and there must be a completed Capacity Assessment tool completed (SLUMS, EXIT 25 or Clox I&II) documenting the lack of Executive Function. The specialist must have a conversation (if the client is able to communicate) with the client and ask them if they had to have a guardian, who would the client choose?
Prior to sending the request to the PFR specialist must:
Create a Service Plan Item and select “Guardianship Voucher” in the Service Plan Type
Supervisor will enter a Service Plan Monitoring Note documenting the voucher was staffed with the specialist and that all other least restrictive options to guardianship have been exhausted.
Email completed APS Specialist Inquiry for Guardianship Voucher to District APS Program Field Representative.
Once the District Program Field Representative (PFR) receives the APS Specialist Inquiry for Guardianship Voucher the PFR will complete the required searches in AVA for previous history, check OSCN and ODCR for any criminal or misdemeanor actions and staff with the Guardianship Voucher Committee. If the voucher is approved the PFR will:
- Email the specialist and supervisor of the approval or denial
- Create a Service Plan Monitoring Note of decision
- Email the specialist, supervisor, Guardianship Voucher Committee and Guardianship Program Manager the appropriate form (application) and Guardianship Handbook for the specialist to send to the proposed guardian to complete and return.
Once the application is completed by the potential guardian and received by the Guardianship Program Manager the voucher will be emailed to the potential guardian. Please note the vouchers are only valid for six (6) months.
The case must remain open in follow-up status until the guardianship is granted or denied by the court and the voucher has been paid by ASD Purchasing. Each month the specialist must follow-up with the potential guardian as to the status of the pending guardianship and enter a Service Plan Monitoring Note documenting your follow-up.
When the guardianship is granted the attorney will email all pleadings to the provided email address (APS.GuardianshipVoucher@okdhs.org). The Guardianship Program Manager will update the case and forward all legal documents to the specialist, supervisor and PFR. The specialist will then:
- Upload all pleadings to Files
- Submit case to supervisor for follow-up or closure as required.
