- Once the issues that required the guardianship are resolved staff with your supervisor to determine if dismissal is appropriate.
- All financial items must be resolved such as the facility becoming the payee, retirement or pensions re-routed to the facility, any bank accounts or other financial accounts have been closed, and the funds provided to the facility. If Medicaid was applied for it must be approved and vending.
- APS should be removed from all the accounts which we were added to in order to conduct business with verification added to files in AVA prior to filing the dismissal.
- Any personal belongings such as ID’s have been given to the client with documentation provided.
Note: If a title 30 guardian is appointed APS would be removed from the account and the new guardian added. Once approval is obtained to dismiss the APS specialist will prepare the Motion to dismiss and the Order setting hearing on dismissal.
- In some instances, they will not set a hearing and have you to complete the Order for signature.
- In some counties the ADA or OKDHS legal will prepare and file your pleadings.
- Once obtained provide a copy to the client and all parties entitled to notice.
- The specialist and Supervisor will staff the case for any final items needed and then both will add a final staffing to the case. Once this is complete notify the District PFR and District PFR will review, add their final staffing and close the guardianship case.
