Findings should include justification of findings including specifics of what was found and why prosecution is recommended. Remember to avoid acronyms. An explanation of how the alleged perpetrator is a caretaker needs to be clear in the case record, although they do not need to be restated in the Findings.
The template for Findings includes:
- Summary of Evidence
- “Between date and date, name took …”
- Justification for Determination (Preponderance = Greater Weight of Evidence)
- Outline specifics of what was found, undue influence, etc.
- If there are conflicting facts as far the interviews, explain why more weight was given to any collateral.
- Identify Intent, if possible
- Explain intent or that a reasonable person should know better.
