Things to consider while investigating Sexual Abuse: unexplained STD’s; recent incontinence (bladder or bowel), frequent UTI’s, bruising (bite marks, pain, burn marks), bleeding around genitals, chest, rectum or mouth, torn or bloody underclothing or bedding, anxiety when near or contact suggested with the abuser.
Definition of Sexual Abuse:
- Oral, anal, or vaginal penetration of a vulnerable adult by, or through the union with, the sexual organ of a caretaker or other person providing services to the vulnerable adult, or the anal or vaginal penetration of a vulnerable adult with any other object by a caretaker or other person providing services to the vulnerable adult;
- For the purpose of sexual gratification, the touching, feeling, or observation of the body or private parts of a vulnerable adult by a caretaker or other person providing services to the vulnerable adult; or
- Indecent exposure by a caretaker or other person providing services to the vulnerable adult.

Example of Appropriate Findings Narrative
Example of Substantiated Allegation:
Client resides at XYZ Assisted Living Facility. She has been diagnosed with multiple health problems including diabetes, chronic kidney disease, stage four cancer, and Huntington’s disease.
A hospice nurse, Punky Brewster, went into client’s room on 02/14/23 and witnessed the alleged perpetrator (AP), Rainbow Brite, with her hand down client’s pants. Ms. Brite has been employed as a certified nursing assistant at the assisted living facility for two months.
When asked about the incident, client reports, “I love Rainbow. She has been so good to me.” She states, “Both of us were touching each other intimately. We were sitting on the side of the bed. It didn’t feel inappropriate to me and not to her either.” When asked if this has happened before, client responds, “Yes, this was the second time. We are in love, no matter what anybody says.”
Ms. Brite denied the allegations stating she was “doing my job.” She states she was checking to see if client’s brief was wet and if she needed to change clothes. She denies being involved in a personal relationship with client stating, “I could never do that. I have a girlfriend.” XYZ Assisted Living Facility has received no other reports involving client or AP. The facility terminated AP.
Example of Unsubstantiated Allegation:
The allegation of caretaker sexual abuse against the alleged perpetrator Petunia Pig has been unsubstantiated based on the evidence obtained by collateral interviews and supporting documents.
The client is 79-year-old woman with a diagnosis of advanced dementia and high blood pressure who utilizes a walker for mobility. The client resides in the memory care unit of an assisted living facility. Client reports that “Mr. Pig took his penis out of his pants and waived it in my face while rubbing it on my cheek.”
The client reports that this incident took place in the dining hall after everyone left. The alleged perpetrator Petunia Pig is a female not a male and according to several incident reports the client has a history of accusing any staff no matter what gender of inappropriate sexual exposure of their penis.
